1. About these terms
These terms apply to the Forstter: Sitter website, the Organization Portal, the admin console and the Sitter App (together, the “Platform”), operated by Forstter (“we”, “us”). By creating an account or using the Platform you agree to them. If you use the Platform for an organization, you agree on its behalf and confirm you're allowed to.
Your organization's written agreement with Forstter, including its Business Associate Agreement (BAA), takes priority over these terms where they differ.
2. Not an emergency service
The Platform schedules and records crisis transport and sitting services. It is not an emergency service and doesn't replace 911, 988 or a clinician's judgment. If anyone is in immediate danger, call 911.
3. Accounts and sign-in
- Accounts are for one named person. Don't share your password, your two-step sign-in or your device.
- Organizations are approved by Forstter before they can send referrals; an organization admin manages who in their organization has access.
- Drivers and sitters apply through the Sitter App and can only take shifts once Forstter approves them.
- Tell us straight away at safety@forstter.org if you think your account has been used by someone else.
4. Using the Platform properly
You agree to:
- Give accurate, complete referral and record information, and correct it when it changes.
- Only open records you need for your role, and use what you see only for the person's care, transport and the work your organization does with us.
- Keep protected health information confidential and follow HIPAA, your organization's policies and the training you've completed.
- Not try to get around access controls, test the Platform's security without our written permission, copy data out in bulk, or disrupt the service.
5. Health information
Protected health information you enter or view is handled under HIPAA and the BAA between Forstter and your organization. Our Privacy Policy explains what we collect and how we protect it.
6. The AI assistant
The assistant answers how-to questions and summarizes records you can already open. It can't change anything and can be wrong, so check its answer against the linked source before acting on it. It doesn't give clinical, medication or legal advice.
7. Transport and sitting services
Response targets, rates and service terms for transport and sitting are set in Forstter's contracts (including with KDADS), not by these terms. Times shown in the Platform, such as ETAs, are estimates.
8. Availability and changes
We work to keep the Platform available around the clock but can't promise it will always be uninterrupted. We may change or improve features; where a change materially affects your organization, we'll tell you in advance.
9. Suspending or ending access
We may suspend an account that puts people or information at risk, breaks these terms, or whose checks (such as a background check or training) have lapsed. Your organization admin can remove your access at any time. Records stay as the law and our contracts require after access ends.
10. Liability
To the extent the law allows, the Platform is provided “as is”, and our responsibility to your organization is governed by its agreement with Forstter. Nothing in these terms limits liability that can't be limited by law.
11. Governing law
These terms are governed by the laws of the State of Kansas.
12. Changes to these terms
We'll post updates here and change the date at the top. If a change is significant, we'll let you know in the Platform before it takes effect.
